<br> to compensate aggrieved persons for damages caused by improper conduct of residents
If there is death or serious injury or loss of property due to or through the unfair conduct of the residents of the area in which the notice is being issued or their branch or class in accordance with section 29, a person living in such area who claims that the injury was caused by such unfair conduct, one of the injured parties. If the time is specified within a month or less, then the application for damages can be submitted to the chief district officer within that period.
(2) Regardless of whether or not additional police personnel have been deployed in the area under section 29, the Chief District Officer may, with the approval of the Government of Nepal, carry out necessary investigations in such areas as described below:
(a) To publish the names of persons who have suffered from or through such unfair conduct.
(b) To calculate and determine the amount of compensation to be given to such persons and the method of payment thereof.
(c) As no damages shall be incurred under sub-section (3) hereafter, any of the residents of such locality other than the petitioner shall bear the amount of damages to be paid. Provided that the damage has been caused by rioting or illegal assembly within such locality as stated above and from the incident such damage has been caused. , the chief district officer should not make the light and score according to this sub-section unless it is determined that the victim is not guilty of the incident.
(3) It shall be lawful for the Government of Nepal to issue an order and not to pay any part of such damages to any person or branch or class of such residents.
(4) According to sub-section (2) the publication of the chief district officer and the amount of damages that have not been removed or the order given may be repeated by the Government of Nepal or an officer appointed by the Government of Nepal, otherwise it shall be final.
(5) No civil action can be taken regarding damages already paid in accordance with this section. Explanation: In this section, the word "resident" has the meaning as per the above section.
